Withdrawal from Contract

Withdrawal from Contract (Returns)

If you are buying as a consumer (or as a sole trader with consumer rights – a person running a sole proprietorship for whom the purchase is not of a professional nature), you may, within 14 days withdraw from a contract concluded at morasy.pl without giving any reason. The full rules are described in § 11 of the document Terms and Conditions.

How to return goods – step by step

  1. Submit a withdrawal statement within 14 days from the day on which you (or a person you designate, other than the carrier) received the goods. The easiest way is to send it by email to morasydladzieci@interia.pl. You can also send it by post to: Morasydladzieci Joanna Szyda, ul. Tucholska 41, 64-920 Piła. You may use the form below, but you do not have to – an unequivocal statement is sufficient, e.g. “I withdraw from the contract for order no. …”. The date of sending the statement is what counts.
  2. You will receive an email from us with confirmation of receipt of the statement.
  3. Send the goods back within 14 days from the date of submitting the statement, to the returns address: Morasydladzieci Joanna Szyda, ul. Bluszczowa 11, 64-920 Piła. It is enough to send the parcel before this deadline expires. Please include your order number (or a copy of the proof of purchase) in the parcel – this will speed up the refund, although it is not a condition of withdrawal.
  4. We will refund your money without undue delay, and no later than within 14 days of receiving your statement – for the goods and for delivery to you (up to the cost of the cheapest standard delivery method offered in the Shop). The refund will be made using the same payment method you used (e.g., to your card, or to the account from which the BLIK payment or transfer was made), unless you expressly agree to another method that is free of charge for you. We may withhold the refund until we receive the goods or proof that they have been sent back.

Important information

  • Return shipping cost of the goods to us is borne by you. Please do not send returns cash on delivery.
  • You may inspect and try on the goods as you would in a brick-and-mortar store. However, you are liable for any diminished value of the goods resulting from using it beyond what is necessary to establish its nature, characteristics and functioning (e.g. wearing, washing, soiling, odor, removed tags). In such a case, we may reduce the refunded amount by the value of the loss.
  • Please pack the goods carefully so that they are not damaged in transit.
  • If the order included several products delivered separately, the 14 days are counted from receipt of the last of them.

When the right of withdrawal does not apply

Pursuant to Art. 38(1) of the ustawa z dnia 30 maja 2014 r. o prawach konsumenta (Polish Consumer Rights Act of 30 May 2014), the right to withdraw from the contract does not apply, among others, to:

  • personalized products – made to your specifications or to meet your individual needs, e.g. name tapes, patches and embroidery with a first name, last name, rank or other text, as well as in a color or size specified by you;
  • products supplied in sealed packaging which cannot be returned after opening for health protection or hygiene reasons, if the packaging has been opened after delivery (we include this information in the product description) – this applies in particular to balaclavas and neck gaiters, which we ship in a sealed bag;
  • products which, after delivery, due to their nature, have become inseparably combined with other items (e.g. a permanently sewn-on patch).

If we added a free name tape with your lettering to a standard product (e.g. a uniform), you may withdraw from the contract with respect to the standard product under the general rules.

Withdrawal from the contract is different from a complaint. If the goods are damaged or do not match your order, you are entitled to the rights described on the page Complaints – also in the case of personalized products.
