§ 4. Technical requirements and electronic services

  1. To use the Shop, including browsing the product range and placing Orders, the following are required: a device with Internet access, a current version of a popular web browser with JavaScript and cookies enabled (necessary for the Cart and Account to work), and an active e-mail address.
  2. Through the Shop, the Seller provides the following electronic services free of charge: maintaining an Account, the Order Form, the Cart, the ability to post Product reviews, and a contact form. The agreement for the provision of the Order Form and Cart services is concluded for a fixed term and terminates when the Order is placed or when the Customer stops using the service; the agreement for maintaining an Account is concluded for an indefinite term.
  3. The Customer is prohibited from providing unlawful content, in particular in reviews or messages addressed to the Seller.
  4. The Seller makes every effort to ensure that the Shop operates continuously and securely; however, to the fullest extent permitted by law, the Seller is not liable for interruptions in the Shop's operation caused by force majeure, unlawful acts of third parties, technical maintenance, or incompatibility of the Shop with the Customer's technical infrastructure. This provision does not limit the Seller's liability towards the Consumer.
  5. Using the Internet involves typical risks (e.g., malware, phishing attempts). The Seller never asks for your Account password or payment card details by email or over the phone.
  6. Complaints concerning electronic services may be submitted to the Seller's e-mail address. The Seller handles them within 14 days of receipt.

§ 5. Customer Account

  1. Browsing the Shop's product range does not require creating an Account. An Order can be placed after logging in to an Account or without registering (as a guest), by providing the data necessary to fulfill the Order.
  2. An Account can be created using the registration form in the “My Account” section or while placing an Order. To create an Account, it is necessary to provide an email address and set a password; the Customer may complete the remaining data (first name, last name, address, phone) in the Account or while placing an Order.
  3. Creating and maintaining an Account is free of charge.
  4. The Customer is obliged to keep the Account password confidential and to provide truthful data.
  5. The Customer may at any time, without giving a reason and free of charge, request deletion of the Account by sending a message to the Seller's email address or in writing to the Seller's address. Deletion of the Account does not affect the fulfillment of Orders placed earlier or the obligation to retain data arising from legal provisions (details in the Privacy Policy).
  6. The Seller may block or delete the Account of a Customer who, despite a request to stop, violates the Terms and Conditions or the law, in particular by providing unlawful content, informing the Customer thereof and stating the reason.

§ 6. Prices and VAT Information

  1. Product prices shown in the Shop are expressed in Polish zloty (PLN) and are final prices that the Customer pays for the Product.
  2. The Seller is exempt from VAT – the Seller uses the subjective exemption under Art. 113(1) of the ustawa z dnia 11 marca 2004 r. o podatku od towarów i usług (Polish Act of 11 March 2004 on Goods and Services Tax). Prices do not include VAT, and no VAT is shown on sales documents.
  3. The Product price does not include delivery costs. Delivery costs depend on the selected delivery method and are shown in the Cart, in the Order Form, and on the page Delivery. The total amount payable (the price of the Products together with delivery costs) is indicated before the Order is placed, including at the moment the Customer expresses their intention to be bound by the Sales Agreement.
  4. The Product price is binding from the moment the Order is placed. Price changes in the Shop do not affect Orders already placed.
  5. For each announcement of a Product price reduction, the Seller, next to the reduced price, states the lowest price of that Product that applied during the 30 days before the reduction was introduced. If the Product has been offered in the Store for less than 30 days, the lowest price applicable from the day it was first offered until the day the reduction was introduced is stated. In the case of a gradual increase of the reduction during a single uninterrupted promotion, the lowest price before the start of that promotion is stated.
  6. The Seller issues proof of purchase in accordance with applicable regulations. At the Customer's request, the Seller issues an invoice without VAT (with a note on the VAT exemption). The Customer may provide the invoice details in the Order Form or send them to the Seller's email address.

§ 7. Placing Orders

  1. Orders can be placed through the Shop 24 hours a day, 7 days a week. Orders placed on non-working days are processed on the next Business day.
  2. To place an Order, you must:

    5. read and accept the Terms and Conditions;

  3. Before placing the Order, the Customer may change the contents of the Cart and the entered data at any time.

The Customer is responsible for the accuracy of the content provided. In case of doubt, the Seller may contact the Customer to confirm it before starting production.

§ 8. Conclusion of the Sales Agreement

  1. After placing the Order, the Customer receives an e-mail at the address provided confirming receipt and acceptance of the Order for processing. The Sales Agreement is concluded when the Customer receives this message.
  2. The Seller provides the Customer with confirmation of the conclusion of the Sales Agreement, including its essential terms, together with the Terms and Conditions (link or attachment), on a Durable medium – by e-mail – no later than at the time the Product is delivered.

  4. The Customer is obliged to pay within 2 calendar days from the date the Sales Agreement is concluded. If this period expires without payment, the Seller may set an additional deadline for payment and, after it expires, withdraw from the Sales Agreement (cancel the Order), informing the Customer by e-mail.
  5. Refunds (e.g., in connection with withdrawal from the contract or acceptance of a complaint) are made using the same payment method used by the Customer, unless the Customer has expressly agreed to another method that does not involve any costs for them. 4. The dispatch period starts on the day the Seller's bank account is credited or the Seller receives payment confirmation from the payment operator. For card or other online payments, the order fulfilment time is counted from the moment the payment is positively authorised.
  5. For an Order comprising Products with different fulfillment times, the fulfillment time of the Order is equal to the longest of them. The Customer may request that the Products be shipped in parts – in such a case, the Seller will inform the Customer of any additional delivery costs before they are incurred.
  6. The carrier's delivery time is counted from the day the shipment is dispatched and depends on the selected carrier (usually 1–2 Business Days). Once the shipment has been dispatched, the Customer receives an email with the tracking number.
  7. If personal pickup is selected, the Product can be collected at ul. Tucholska 41, Piła after receiving an email from the Seller that the Order is ready for pickup.
  8. It is recommended that the Customer, if possible, inspect the shipment in the courier's presence and, in the event of damage, have a damage report drawn up. This is not a condition for the Consumer to exercise their rights under a complaint.
  9. If the Seller fails to deliver the Product on time, the Consumer may request delivery within an additional, appropriate time limit and, if that time limit expires to no effect, withdraw from the contract under Art. 543¹ of the Kodeks cywilny (Polish Civil Code).
  10. The risk of accidental loss of or damage to the Product passes to the Consumer when the Product is handed over to the Consumer (or to a person designated by the Consumer other than the carrier).

§ 11. Right of Withdrawal

  1. The Consumer may, within 14 days withdraw from the Sales Agreement without giving any reason and without incurring any costs, except for the costs specified in sections 8–9.
  2. The time limit runs from the day on which the Consumer or a third party designated by them, other than the carrier, took possession of the Product, and in the case of a Contract covering multiple Products delivered separately, in batches, or in parts – from taking possession of the last Product, batch, or part.
  3. To withdraw from the contract, the Consumer submits an unequivocal statement to the Seller, e.g. by e-mail to morasydladzieci@interia.pl or in writing to the Seller's address. The Consumer may use the model withdrawal form available on the page Withdrawal from Contract, but this is not mandatory. To meet the deadline, it is sufficient to send the statement before it expires.
  4. The Seller shall promptly confirm to the Consumer receipt of the withdrawal statement on a Durable medium (by email).
  5. In the event of withdrawal, the Agreement is deemed not to have been concluded.
  6. The Seller refunds to the Consumer, without undue delay and no later than 14 days from the date of receipt of the withdrawal statement, all payments made, including the cost of delivering the Product – except for additional costs resulting from the Consumer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller. The refund is made in the manner specified in § 9(5).
  7. The Seller may withhold the refund until it receives the Product back or until the Consumer provides proof of having sent it back, whichever occurs first.
  8. The Consumer sends the Product back to ul. Bluszczowa 11, 64-920 Piła without undue delay, no later than 14 days from the date of withdrawal from the contract. To meet the deadline, it is sufficient to send the Product back before it expires. The Consumer bears the direct costs of returning the Product.
  9. The Consumer is liable for any diminished value of the Product resulting from using it beyond what is necessary to establish the nature, characteristics and functioning of the Product (e.g. wearing beyond trying on, washing, removing tags, soiling). Trying on clothing in the way it is done in a brick-and-mortar store is permitted.
  10. Right of withdrawal from a distance contract does not apply to the Consumer, in particular with respect to contracts (Art. 38(1) of the ustawa z dnia 30 maja 2014 r. o prawach konsumenta (Polish Consumer Rights Act of 30 May 2014)):
    1. in which the subject of performance is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy their individual needs – this applies in particular to Personalized Products, e.g. name tapes, patches and embroidery with text, color or size specified by the Consumer;
    2. where the subject of performance is an item delivered in a sealed package which cannot be returned after opening for health protection or hygiene reasons, if the package has been opened after delivery (information about such a nature of the Product is provided in its description); this applies in particular to balaclavas and neck gaiters, which we ship in a sealed bag;
    3. in which the subject of performance consists of items that, after delivery, by their nature, become inseparably combined with other items.
  11. If a personalized Product was added free of charge to a standard Product (e.g. a free name tape with a uniform), withdrawal from the contract with respect to the standard Product is possible under the general rules. Detailed information and the model form can be found on the page Withdrawal from Contract.

§ 12. Liability for Conformity of the Product with the Contract (Complaints)

  1. The Seller sells new Products and is obliged to deliver a Product that conforms to the contract.
  2. With respect to Consumers, the Seller is liable for the Product's lack of conformity with the contract under the rules set out in Chapter 5a of the ustawa o prawach konsumenta (Polish Consumer Rights Act) (art. 43a–43g). The provisions of the Kodeks cywilny (Polish Civil Code) on statutory warranty (rękojmia) do not apply to contracts concluded with Consumers.
  3. The Seller is liable for any lack of conformity of the Product with the contract that existed at the time of its delivery and became apparent within 2 years from that moment. A lack of conformity that becomes apparent within this period is presumed to have existed at the time of delivery, unless the Seller proves otherwise or this presumption is incompatible with the specifics or nature of the Product.
  4. If the Product does not conform to the contract, the Consumer may demand its repair or replacement. The Seller may replace the Product when the Consumer requests repair, or repair it when the Consumer requests replacement, if bringing it into conformity in the manner chosen by the Consumer is impossible or would require excessive costs. If repair and replacement are impossible or would require excessive costs, the Seller may refuse to bring the Product into conformity with the contract.
  5. The Consumer may submit a statement of price reduction or withdrawal from the contract, where: the Seller has refused to bring the Product into conformity with the contract or has failed to do so; the lack of conformity persists despite an attempt to bring the Product into conformity; the lack of conformity is so significant that it justifies an immediate price reduction or withdrawal; or it is clear from the Seller's statement or the circumstances that the Seller will not bring the Product into conformity within a reasonable time or without undue inconvenience. The Consumer may not withdraw from the contract if the lack of conformity is insignificant.
  6. The costs of repair or replacement, including shipping costs, are borne by the Seller. The Consumer makes the Product to be repaired or replaced available to the Seller, and the Seller collects it at its own expense – before sending the Product back, please contact us by email to arrange free shipping. The Product may also be sent to ul. Bluszczowa 11, 64-920 Piła; reasonable shipping costs of the Product under complaint will be reimbursed to the Consumer.
  7. A complaint may be submitted by e-mail to morasydladzieci@interia.pl or in writing to the Seller's address. It is recommended to provide: contact details, the Order number, a description of the non-conformity and the date it was discovered, and the demand. The model complaint form can be found on the page Complaints; its use is not mandatory.
  8. The Seller responds to the Consumer's complaint without undue delay, no later than within 14 days of its receipt. Failure to respond within this period means that the Seller has accepted the complaint as justified.
  9. In the event of withdrawal from the contract or a price reduction, the Seller refunds the amount due without undue delay, no later than 14 days from the date of receipt of the Consumer's statement.
  10. If a warranty has been granted for the Product, information about it and its terms can be found in the Product description. The warranty does not exclude, limit or suspend the Consumer's rights under the provisions on conformity of goods with the contract.

§ 13. Entrepreneur with consumer rights

  1. The provisions of the Terms and Conditions concerning the Consumer with regard to the right of withdrawal from the contract (§ 11), conformity of the Product with the contract (§ 12) and prohibited contractual clauses apply to an Entrepreneur with consumer rights.
  2. An entrepreneur with consumer rights does not benefit from the protection institutions provided for Consumers, i.e., district (municipal) consumer ombudsmen and the President of UOKiK.
  3. With respect to Customers who are Entrepreneurs and are not Entrepreneurs with consumer rights, to the fullest extent permitted by law: the Seller's liability under statutory warranty for defects (rękojmia) is excluded, and the Seller's liability is limited to the price paid for the Product and delivery costs, excluding lost profits. The right of withdrawal from the contract referred to in § 11 does not apply to such Customers.

§ 14. Product Reviews

  1. Customers may post reviews and ratings of Products in the Shop.
  2. Review verification: a review of a Product may be posted only by a Customer logged in to an Account who has purchased that Product in the Shop. The Shop automatically checks whether an Order including that Product was placed from the Account (e-mail address); such reviews are marked as coming from a verified buyer. Reviews are not sponsored or remunerated in any way.
  3. The Seller publishes both positive and negative reviews. The Seller may refuse to publish or remove a review only if it contains unlawful, offensive, or vulgar content, personal data of third parties, or advertising, or if it does not concern the Product – in such a case, the Seller informs the author of the reason.
  4. Reviews are published starting with the most recent. The average Product rating is the arithmetic mean of all published ratings.
  5. By adding a review, the Customer grants the Seller a free, non-exclusive license to publish it in the Store. The Customer may request deletion of their review at any time.

§ 15. Out-of-court complaint handling and redress procedures

  1. The Consumer may use out-of-court methods of handling complaints and pursuing claims. Their use is voluntary and requires the consent of both parties. The Seller states in each case whether it agrees to participate in such proceedings.
  2. In particular, the Consumer may:
    1. seek free assistance from the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g. Federacja Konsumentów, Stowarzyszenie Konsumentów Polskich);
    2. apply to the voivodeship inspector of the Inspekcja Handlowa (Trade Inspection) with a request to initiate mediation proceedings for the amicable settlement of the dispute (the competent authority for the Seller is the Wojewódzki Inspektorat Inspekcji Handlowej w Poznaniu (Voivodeship Trade Inspection Inspectorate in Poznań));
    3. apply to the permanent amicable consumer court operating at the voivodeship inspector of the Inspekcja Handlowa (Trade Inspection) to have the dispute resolved;
    4. use the free consumer helpline or the advice available on the website prawakonsumenta.uokik.gov.pl.
  3. Information on out-of-court dispute resolution methods and the register of entities authorized to conduct them is available on the website of the Urząd Ochrony Konkurencji i Konsumentów (Office of Competition and Consumer Protection, UOKiK): uokik.gov.pl.

§ 16. Personal data

  1. The controller of the Customers' personal data is the Seller.
  2. The rules for processing personal data, including the purposes, legal bases, data recipients and the rights of data subjects, are described in Privacy Policy. Information about cookies is contained in Cookie Policy.
  3. Providing personal data is voluntary but necessary to conclude and perform the Sales Agreement.

§ 17. Amendments to the Terms and Conditions and Final Provisions

  1. The Seller may amend the Terms and Conditions for important reasons, in particular: changes in the law, changes in payment or delivery methods, changes in the scope or manner of providing electronic services, or the need to remove ambiguities or errors.
  2. The Seller announces any amendment to the Terms and Conditions on the Shop's website and, for Customers with an Account, also by e-mail, at least 7 days in advance. A Customer with an Account who does not accept the changes may delete the Account before the date they take effect.
  3. Orders placed before the amendments to the Terms and Conditions take effect are fulfilled on the basis of the Terms and Conditions in force on the date the Order was placed.
  4. In matters not regulated by the Terms and Conditions, the provisions of Polish law apply, in particular the Kodeks cywilny (Polish Civil Code), the ustawa o prawach konsumenta (Polish Consumer Rights Act), the ustawa o świadczeniu usług drogą elektroniczną (Polish Act on Providing Services by Electronic Means) and Regulation (EU) 2016/679 of the European Parliament and of the Council (RODO (GDPR)).
  5. Disputes with Consumers are resolved by the courts having jurisdiction under the provisions of the Kodeks postępowania cywilnego (Polish Code of Civil Procedure). Disputes with Entrepreneurs who are not Entrepreneurs with consumer rights are resolved by the court having jurisdiction over the Seller's registered office.
  6. These Terms and Conditions enter into force on 25 October 2026. Contracts concluded before that date are governed by the terms and conditions in force on the date of their conclusion.
